The Chieftains of Cuncolim

This House unanimously and strongly recommends that the contents on "The Chieftains of Cuncolim” be introduced at the appropriate stage in the school and college curriculum consequent on the decision of the Government of Goa to celebrate 15th July 1583 (Cuncolim Revolt) as the National War Memorial Day. The  Gaonkar's of Cuncolim stood up to the colonial powers boycotting the colonial  decrees and registered their protests by not paying any revenue to the Government centuries before similar protests and boycotts got popularized as the “non- cooperation movement”. These deeds of courage, valiant struggle and sacrifices of Goan's and specially the people of Cuncolim should be learnt and taught as part of Goa’s political struggle against colonial powers strictly as historical facts without fanning xenophobia of any kind.

“Fear and Anxiety in the Minds of the Residents of Paroda & Commuters passing from Margao to Quepem about the Annual Flooding at Paroda during Monsoon. The Floods cause Damage to Houses, Fields & Loss to Farmers. The rise in Waters also causes Threat to the Lives of the People. There are Wooden Logs below the Paroda Bridge which are blocking the flow of Water and need to be removed. The Desilting of River Kushavati also needs to be done on top most priority as the Monsoons are fast approaching. There needs to be a Scientific Study done on the reasons of Flooding by National Institute of Oceanography. Government must take immediate steps on this issue of Public Importance”.

\"Fear and Anxiety in the minds of the people from Cuncolim Constituency; especially those residing in Chandor area about the status of the State Highway 8. The recent Tender notice of the Government pertaining to some works mentioned the road passing through  Chandor as State Highway 8. It was the demand of the local residents of Chandor and surrounding areas to de notify the said State Highway as Major District Road.

Stop Unjust Customs of Widow Discrimination

Concerns in the Minds of the People to the prevalence of unjust customs of widow discrimination, widow abuse and widow isolation in the State. Though there are no registered complaints, the isolation, discrimination and abuse is taken for granted as part of custom, tradition and religious or social practice. A few Village Panchayats in Goa have taken resolutions against such outdated and inhuman customs stating that the widow should be treated on par with Married Woman. Steps be taken in co-ordination with Department of Panchayats and Goa State Women’s Commission to convene Gram Sabhas of Village Panchayats to express solidarity with widow and boost the confidence of all women against such obsolete and archaic practices and mind-set prevailing in the community. Government should contemplate on bringing a Law to stop such unjust practices.

012A - AUCTIONING OF MINING BLOCKS

*WILL the Minister for Mines and Geology be pleased to state:

(a) whether the Government has conducted a study to assess the quantum and quality (Grade Fe %) of the iron ore resources at the mining blocks that are recently e-auctioned or being auctioned in the State; if so, furnish the reports submitted by such agencies appointed by the Government along with the copies of all file notings and the criteria followed and procedure adopted for selection of  such agency;
(b) the details along with the copies of all relevant file notings and documents of the methodology/criteria adopted by the Government to evaluate and fix the reserve price pertaining to each Iron Ore Mining Block that has been auctioned recently or being auctioned;
(c) whether the Government had conducted any assessment pertaining to high premium committed by the successful bidders vis-à-vis feasibility to operate auctioned Iron Ore Blocks; if so, the basis on which the Government is of the opinion that the successful bidders will be able to operate the Blocks and carry out mining business even after paying premium over 100% (63.55% for Bicholim Mineral Block, 99.25% for Sirigao Mineral Block, 111.28% for Monte-de-Sirigao Mineral Block and 86.40% for Kalay Mineral Block);
(d) the details along with copies of file notings and other documents pertaining to the number of bidders that participated in the first stage and second stage of the bidding process of each auctioned Iron Ore Block recently concluded along with copies of the presentations made before the bidders by various Agencies/Government, copies of queries received by the Government from various bidders and copies of the Action Taken Report/Responses to the queries made by the Government; the details of the premium/final price offer offered by each bidder during the first and second stage of the bidding process, for each Iron Ore Mineral Block auctioned so far; and
(e) whether any Mining Company/Companies/Erstwhile Lessees that were involved in illegal mining activities or that  were listed as defaulters in the Justice Shah Commission Report on illegal mining or the Mining Company/Companies/Erstwhile Lessees who have failed to pay the fine/penalty/levy as per findings of Chartered Accountants Audit Report/CAG Report; Company/Companies/Erstwhile Lessees against whom cases were filed before SIT or the Mining Company/Companies/Erstwhile Lessees whose Owners/Directors were arrested for illegal mining activities were allowed to participate in the e-auctioning of the Iron Ore Mining Block; if so, the names of all such Companies/Erstwhile Lessees and the reasons to allow them to participate in the e-auctioning of Iron Ore Mineral Blocks; the reason the Iron Ore Blocks are not auctioned by combining two or three leases of Erstwhile Lessees to facilitate optimum utilization of resources trapped at common boundary operation?

(c) the details of the Methodology/procedure adopted by the Government to monitor whether the On-shore and Off-shore Casinos operate within the stipulated area of operation/capacity for operation; the details with copies of all relevant documents such as Inspection report/site visits etc.;
(d) the details of all On-shore and Off-shore Casinos that have outstanding payment with respect to their licenses/fees along with their names, name of the owner, location, outstanding amount to be paid and the action taken by the Government against such Casinos and details of all waivers/moratoriums/exemptions given to Casino operators in the State during the Covid-19 pandemic and otherwise along with the details of the total amount that the Government would have earned if the waiver/moratorium was not given; and
(e) the details and copies of all complaints relating to illegal Casino operations and illegal activities in Casinos reported since 2019 along with the names of the complainant, complaint details and Action Taken Report as on date?

a) Whether the State Election Commission has begun with the process of Delimitation of wards in various Panchayats and Municipal areas; if so the details thereof with copies of relevant file notings and documents;

Yes,

  • The ensuing General elections to Ponda and Sanquelim Municipal council are scheduled to be held in the month of May 2023. 
  • The Commission initiated the work of carrying out delimitation of Municipal wards 6 months prior to the completion/expiry of the term of the existing Municipal Council. 
  • The copies of relevant file notings and documents are as per annexure “A”.

b) The methodology /criteria  adopted by the State Election Commission for Delimitation of wards in various Panchayats and Municipal areas; furnish details with copies of relevant file notings and documents;

Sir,

Delimitation of Village Panchayat wards and Municipal wards is carried out as per section 7 of the Goa Panchayat Raj Act 1994 and Rule 3 of the Goa Panchayat and Zilla Panchayat (Election Procedure) Rules, 1996 and section 9 and Section 10 of the Goa Municipalities Act, 1968. 

Following criteria followed for delimitation of wards 

  1. For  dividing  a   Panchayat  area  into wards   the  population  or   the  number  of   voters  of  each   ward  shall,  as   far  as  may   be practicable be equal and be in the same proportion as the number of members fixed under section 7 of the Goa Panchayat Raj Act 1994 bears to the total population or the number of voters of the Panchayat.
  2. Municipal area is divided into wards considering the number of councillors fixed by the Department of Urban development under Section 9 of the Goa Municipalities Act, 1968.
  3. Parts and Sections of Electoral Roll of the Goa Legislative Assembly prepared under the provisions of the Representation of Peoples Act, 1950 (Central Act 43of 1951) currently in force is utilised for delimitation of Village Panchayat and Municipal wards.
  4. A particular area is kept together and the members of a single household are placed in same ward.
  5. Due consideration to geographical contiguity and natural boundaries.
  6. Distance to polling booth shall be within 2 kms while clubbing / dividing sections/parts .
  7. Each ward is assigned a separate serial number.

The copies of relevant file notings and documents are as per annexure “B”.

c) Whether the State Election Commission received any complaints / representations /memorandums/suggestions/ Observations / Objections pertaining to Delimitation of wards in various Panchayats and Municipal areas; if so, the details with copies of the same along with action taken by the State Election Commission;

Yes,

The details of complaints/representations /memorandums/suggestions/Observations / Objections pertaining to Delimitation of wards in various Panchayats and Municipal areas along with copies of the same and action taken by the respective Electoral Registration Officers is as per annexure   “C”. (The reply being Voluminous is placed on the table of the House)

d) Whether the State Election Commission will take cognizance of the Orders issued by Hon’ble Supreme Court of India and Hon’ble High Court of India pertaining to Reservation of Wards for various categories in the preciously held Panchayat and Municipal Elections while undertaking the Delimitation of wards in Panchayat and Municipal areas ; if so furnish copies of the Court Orders of which cognizance will be taken by State Election Commission; if not the reasons for the same

Yes,

The State Election Commission carries out the delimitation and reservation of all the local bodies considering the provisions specified in the The Goa Panchayat Raj Act, 1994 and Rules, The Goa Municipalities Act,1968 and the City of Panaji Corporation Act, 2002 and Rules. The State Election Commission also takes the cognizance of the Orders issued by Hon’ble Supreme Court of India and Hon’ble High Court pertaining to Reservation of Wards for various categories in the local bodies.

The Copies of the Orders and Judgements passed by the Hon’ble Supreme Court regarding reservation of seats in local bodies as as per annexure “D”.

e) Whether the State Election Commission will hold the Municipal elections of Sanquelim and Ponda Municipal Councils before the expiry of the term of present Council; if so the details of the preparation undertaken by the State Election Commission for the same along with details of Delimitation of wards done , number of wards etc, for each Municipality ; if preparations are not done , the reasons for the same?

Yes,

The State Election Commission will hold the Municipal elections of Sanquelim and Ponda Municipal Councils before the expiry of the term of present Council. 

The Commission initiated the work of delimitation of Municipal wards six months prior to the expiry of the term of present council.

The Mamlatdar of Ponda Taluka and Mamlatdar of Bicholim Taluka are appointed as the Electoral Registration Officer (ERO) and Awal Karkun in office of the above referred Mamlatdar’s are  appointed as Asst. Electoral Registration Officer (AERO) for the Municipal Council under their jurisdiction to carry out said task of delimitation vide order No. 4/29/DEL/2022-23/SEC/4869    dated: 08/12/2022.

 

The delimitation draft of municipal wards was kept open for the general public for 10 days for submitting their suggestions/ corrections /modifications pertaining to said delimitation draft of the Municipal Wards.

The EROs   will submit the final delimitation draft to the State Election Commission after considering the suggestions/ corrections /modifications submitted by the general public if required. 

The Commission will forward the final delimitation draft to the State Government for consultation purpose as specified in the Goa Municipalities Act, 1998, after completing the consultation part the Commission shall publish the same in the official gazette. 

The number of councillors fixed for Sanquelim Municipal Council is 12 and Ponda Municipal Council are 15 as per the order issued by the Department of Urban Development dated 21/02/2023.
